Volunteer Agreement and Waiver

Volunteer Agreement
Services: I, the undersigned, am engaging with Drive with Care Foundation in a volunteer capacity. I agree to perform my duties to the best of my abilities and to represent Drive with Care Foundation in a professional manner.

Volunteer Status: I understand that as a volunteer, I will not be compensated for any time spent volunteering, nor am I entitled to benefits, including employment insurance benefits upon the termination of this agreement or as a result of this service.

Policies and Procedures: I agree to abide by all Drive with Care Foundation rules, regulations, policies and procedures, including any safety procedures or protocols.

Confidentiality: I acknowledge that during my volunteer assignment with Drive with Care Foundation, I may have access to confidential information related to its operations or its clients. I agree to maintain the confidentiality of any such information and agree not to disclose or use such information without the express written consent of Drive with Care Foundation.

Non-Representation: I will not represent myself as an employee, agent, or contractor of Drive with Care Foundation.

Term/Termination: My volunteer status can be terminated by either myself or Drive with Care Foundation at any time, without prior notice or reason.

Volunteer Release and Waiver of Liability

Assumption of Risk: I understand that the activities I am involved in may have inherent risks and I hereby acknowledge and assume all risks and hazards incidental to my participation in all volunteer activities.

Waiver and Release of Liability: I, for myself, my heirs, executors, administrators, personal representatives, successors and assigns, waive and release any and all rights, claims and courses of action I have or may have against Drive with Care Foundation, its affiliates, subsidiaries, officers, directors, employees, agents, successors, and assigns that may arise as a result of my participation in the volunteer activities.

Indemnification: I will indemnify, defend, and hold harmless Drive with Care Foundation, its officers, directors, employees, agents, and volunteers from all losses (including attorney’s fees and costs), damages, liabilities, claims, actions, and proceedings of any kind for injury or death of any person or damage to any property arising out of or in connection with my negligent or unlawful act or omission, willful misconduct, or breach of this Agreement.

Photographic Release: I grant Drive with Care Foundation the irrevocable, perpetual, worldwide right to use, reproduce, display, perform, adapt, modify, distribute, have distributed, and promote my image or likeness in any form of media for any lawful purpose.

Governing Law and Venue: This Agreement shall be construed under the laws of the State of Delaware. Any legal suits, actions or proceedings arising out of or relating to this Agreement shall be instituted in the courts of the State of Delaware.
